DearIt has come to our attention that you may have volunteered to perform the duties of a supervisor. So there is no misunderstanding, there are no provisions in the May 1, 1993 Contract, Forward to the Job Manual, or a special agreement, that allows a bargaining unit member to become a supervisor and then return to the bargaining unit.
Pursuant to the contract, the Forward to the Job Manual, a letter of understanding between the Company and the Union dated May 2, 1993, and long practice, the only circumstances in which a member may accept an assignment to fulfill the directive duties of a supervisor or foreman, and then return to the position the member formerly held are when:
If the assignment you have accepted does not meet these criteria,
you have left the bargaining unit and have forfeited all your rights under the agreement, including any right to return, seniority, etc. Further, your obligation to pay dues terminated on commencement of the assignment.
It is, as you might imagine, extremely important that you immediately notify the Union, in writing, of the nature of your assignment and its duties, the name of the supervisor or foreman whose absence led to the assignment, the date on which the assignment commenced, the expected date on which the supervisor or foreman is expected to return, and provide copies of all pay check stubs or automatic deposit slips demonstrating your rate of pay during the assignment.
Should you have any questions, do not hesitate to contact me.
Fraternally,
David T. Kotecki
